Michael Jordan Tells Court He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial

The basketball icon, introducing himself formally in a Charlotte court on Friday, admitted that his drive to win and novelty within the sport emboldened his effort with 23XI Racing to confront Nascar over alleged violations of antitrust rules.

Financial Stakes and a Competitive Drive

Jordan shared operational insights of his 23XI team, saying he invested $40m of his personal wealth into the Cup Series operation co-founded with business partner Curtis Polk and driver Hamlin.

“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “As a newcomer, I had no fear. I felt I could challenge Nascar as a whole. From my perspective, the sport it needed to be looked at through a new lens.”

Central Issue: Franchise System and Renewal Demands

At issue is the end of a 2016 deal where Nascar granted each team a “charter”. This system mirrors other professional sports with independent franchises, like the NBA’s Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar insisted on charter membership renewals.

Jordan testified for an hour and exited the courthouse to pandemonium, with fans and media clamoring for a glimpse or a photo of the global icon.

Leading the Legal Charge

Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to change a business model Jordan contended is unlawful to keep two hands on the wheel.

At issue for Jordan and Heather Gibbs, who preceded Jordan, are events from September 2024. She recounted a hectic and tense six hours where the racing circuit told teams they must sign a contract extension. This agreement spanned over a hundred pages detailing pay for chartered teams and a guaranteed spot in every race.

A Refusal to Sign

Jordan said that 23XI and Front Row Motorsports decided their sole viable path was to decline to sign that 112-page package and litigate the matter. The other 13 organizations agreed to the terms.

The team owners approached Nascar about possible changes or extension options. Nascar refused to engage, Jordan said.

The Bottom Line: Victory

But in the end, the resistance against what he saw as a unsustainable system was driven by the familiar goal for Jordan: Winning.

“Denny convinced me adding a third car improved our chances to win,” he said, sharing that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I took the plunge.”

Account from the Gibbs Family

Gibbs described her push for indefinite franchises, submitted in a formal letter to Nascar. She testified the pressure of the contract signing demand didn’t sit well.

She said, the team founder first tried to call and talk Nascar out of demanding signatures, but Nascar’s leader refused the appeal.

“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, that’s what I have. If there are 30, that’s the number.”
