The former personal attorney for Donald Trump has left her position as the US Attorney for New Jersey. This decision was prompted by a court battle that questioned her legal standing to serve.
Attorney General's Statement
The head of the Justice Department, the Attorney General, confirmed Habba's resignation on the start of the week. Bondi stated that the court's "flawed" ruling made it unworkable for the official to lead the department effectively.
"Let no one confuse compliance for surrender," Habba stated. "The effort will now reach across America."
Court Ruling
Her resignation was triggered by a federal appellate panel determined that she had been unlawfully serving as the top prosecutor. This judgment is could influence scores of legal proceedings in New Jersey.
The court ruled that a temporary posting that skirted Senate approval breached the federal law governing appointments.
Ongoing Legal Battle
It was also stated that Habba will remain at the justice department as a high-level advisor. Habba plans to pursue additional appeals of the court's action, in the hope of achieving a reversal.
Writing online, she wrote that judges "should not be able to override the President's choice of prosecutors responsible for carrying out the fundamental role of the presidency of enforcing the law."

Habba, first joined the former president's legal defense in 2021. She went on to defended her client in his hush-money trial in 2024, when he was guilty verdict on dozens of charges of falsifying business records.
Before Habba took on the role of US Attorney, Donald Trump had announced he was selecting her as his presidential counsellor during his second administration, labeling her as deeply loyal and a dedicated fighter for justice.
