US Court Mandates Release of Abrego Garcia from Immigration Custody
A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.
The case stems from a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling allegations, he was held in immigration custody.
In her decision, the judge pointed out that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
